Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Lumen XR ("Lumen", "we", "us"). By creating an account or using the Service, you agree to these Terms.

2. Accounts

You are responsible for the content you upload, the learners you grant access to, and the security of your credentials. Notify us promptly at legal@lumenxr.com if you suspect unauthorized access.

3. Subscription & billing

Paid plans are billed in advance monthly or annually. Seat counts are reconciled based on 30-day-active authoring users. You may cancel at any time; cancellations take effect at the end of the current billing period. Refunds are issued at our discretion for material service failures.

4. Acceptable use

You will not use Lumen to upload unlawful content, to train content that infringes another party's intellectual property, or to attempt to breach the Service's security. We may suspend accounts that violate this section.

5. Your content

You retain all ownership of content you upload. You grant Lumen a limited license to host, process, and deliver that content solely to operate the Service on your behalf. You are responsible for confirming you have the right to upload and publish any content.

6. AI-generated content

Lumen uses third-party AI providers (including Anthropic and OpenAI) to generate hotspots, transcriptions, and 3D assets from your inputs. Generated output is provided "as-is" without warranty of accuracy or fitness for a particular purpose. AI-generated content may contain errors, omissions, or inaccuracies. You must review and verify all generated content before publishing, especially for safety-critical training.

7. Safety training disclaimer

Lumen is a content authoring tool — not a safety consultant, training certifier, or regulatory advisor. You are solely responsible for verifying the accuracy, completeness, and regulatory compliance of all training content before deploying it to learners. Lumen does not validate that generated content meets OSHA, ISO, or any other regulatory training requirements. AI-generated training must be supplemented with qualified human review by subject-matter experts before use in safety-critical contexts.

8. Indemnification

You agree to indemnify and hold harmless Lumen, its officers, and employees from any claims, damages, or expenses arising from: (a) your reliance on AI-generated content deployed without adequate review, (b) your failure to verify training content accuracy before publishing to learners, or (c) your violation of these Terms.

9. Service availability

We target 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance and emergency fixes may cause downtime.

10. Limitation of liability

To the maximum extent permitted by law, Lumen is not liable for indirect, incidental, or consequential damages. Our aggregate liability in any 12-month period is limited to the fees you paid to Lumen during that period.

11. Termination

Either party may terminate at any time. On termination we will make your published data available for export for 30 days, after which it may be deleted.

12. Changes

We may update these Terms. Material changes will be announced via email at least 30 days before taking effect.
